29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels had not been protected by guardrail systems, safety net system, or personal fall arrest system.  On or about November 1, 2023, Juan Ortiz DBA Top-Notch Roofing LLC did not ensure that each employee roofing a residential building located at 544 Forest Park Drive in Foristell, Missouri, was protected by personal fall arrest systems. Employees were exposed to falls from heights greater than 10 feet.

29 CFR  1926.503(a)(1): The employer had not provided a training program for each employee who might have been exposed to fall hazards. The program had not enabled each employee to recognize the hazards of falling and had not trained each employee in the procedures to be followed in order to minimize these hazards.  On or about November 1, 2023, Juan Ortiz DBA Top-Notch Roofing LLC did not provide a training program for each employee who was exposed to fall hazards while roofing a residential building located at 544 Forest Park Drive in Foristell, Missouri. Employees were exposed to falls from heights greater than 10 feet. The exposed employees were not enabled to recognize the hazards of falling nor were they trained in the procedures to be followed to minimize fall hazards.

29 CFR  1926.1053(b)(1): When portable ladders had been used for access to an upper landing surface, the ladder side rails had not extended at least 3 feet (.9 m) above the upper landing surface to which the ladder had been used to gain access.  On or about November 1, 2023, Juan Ortiz DBA Top-Notch Roofing LLC did not ensure that a portable extension ladder used to access the roof of a residential building located at 544 Forest Park Drive in Foristell, Missouri, was extended at least 3 feet above the edge of the roof.  The ladder was extended approximately 1 foot above the roof, exposing employees to falls from up to approximately 10 feet in height.
