29 CFR  1926.102(a)(1): The employer had not ensured that each affected employee had used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  On or about November 1, 2023, S & V Construction LLC did not ensure that each employee exposed to eye hazards from flying particles, while operating a pneumatic nail gun, utilized eye protection in a worksite at 3811 Rocky Mound Drive in Wentzville, Missouri.

29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels had not been protected by guardrail systems, safety net system, or personal fall arrest system.  On or about November 1, 2023, S & V Construction LLC did not ensure that each employee roofing a residential building, at least 10 feet above the lower level, was protected from falls by use of guardrails or personal fall arrest systems in a worksite at 3811 Rocky Mound Drive in Wentzville, Missouri.

29 CFR  1926.59: The employer had not developed a written hazard communication program in accordance with 29 CFR 1910.1200(e)(1) as incorporated by reference:  29 CFR 1910.1200(e)(1): Employers had not developed, implemented, and maintained at each workplace, a written hazard communication program which at least described how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets (SDSs), and employee information and training would be met.  On or about November 1, 2023, S & V Construction LLC did not develop, implement, and maintain at each workplace a written hazard communication program which at least described how the criteria specified in paragraphs (f) for labels and other forms of warning, (g) for SDSs, and (h) for employee information and training would be met. Gasoline was utilized by employees to power air compressors for pneumatic nail guns in a site located at 3811 Rocky Mound Drive in Wentzville, Missouri. The employer did not have a written hazard communication program nor did they have SDSs available to employees.
