29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:   An effective hearing conservation program which included noise monitoring, audiometric testing of employees and training of employees as detailed in the standard was not instituted by Terrazzo & Marble Supply Co. of Illinois.  a) An employee operating the wet tile saw was exposed to continuous noise levels at 117.9% of the allowable OSHA 8-hour time-weighted average (TWA) sound level for noise (85 dBA). The equivalent dBA level of 117.9% is approximately 91.2 dBA. The sampling was performed for 495 minutes during an 8-hour shift on November 14, 2023.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.1053(d)(1): The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2) or the scheduled monitoring option in paragraph (d)(3) of this section:  a) On or about November 14, 2023, the employer did not assess the exposure of employee(s) exposed to respirable crystalline silica when wet cutting, grinding and polishing on terrazzo tiles samples. An employee in the Sample Department conducting wet cutting on terrazzo tiles samples was exposed to 17.6 �g/m3 of respirable crystalline silica dust.   No abatement certification or documentation is required for this item.
