OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment that were free from recognized hazards and were causing or likely to cause death or serious physical harm to employees:  On or about November 1, 2023, at a job site located at 3611 Old Route 5, Camdenton, Missouri, the employer exposed employees to the recognized struck-by hazards posed by flying polyvinyl chloride (PVC) piping fragments associated with the use of PVC piping under pressure.  The employer required employees to use compressed air contained in PVC at approximately 115 psi as part of the manufacturing process for pumps and pump components to clean parts and to power pneumatic crane hoists used to lift parts.    Among other methods, feasible and acceptable methods include:  a.	Not using PVC pipe under pressure. According to the Plastic Pipe Institute and the Plastic Pipe and Fittings Association, " PVC piping does not possess shatter-resistant properties, and failure of the piping presents a serious hazard to employees from resultant flying shards or pipe fragments which become rapidly propelled by the released energy of a suddenly decompressing gas" ASME B31.3, A323.4.2 states "PVC and CPVC shall not be used in compressed air or other compressed gas services", or ASME B31.9 paragraph 923.3.2 states "PVC, CPVC and PVDF, which exhibit brittle failures as determined by ASTM F412, shall not be used for compressed air or gas service."  b.    Replacing PVC piping and fittings with piping and fittings designed to be used under pressure such as metal piping and fittings, which are rated to transport compressed air in exposed above-ground locations or PVC piping and fittings with Acrylonitrile-Butadiene Styrene (ABS) pipes and fittings, which are shatter-resistant and manufactured for above-ground use of compressed air.  c.  Following the guidelines in sections 842.32, 842.43 and 849.52(b) of the American National Standards Institute/American Society of Mechanical Engineers (ANSI/ASME) B31.8-1986, Gas Transmission and Distribution Piping Systems Standard that state, limit the operating pressure of plastic piping distribution systems to 100 pounds per inch (psi) and prohibit the installation of such systems above ground except where ". . . the above ground portion of the plastic service line is completely enclosed in a conduit or casing of sufficient strength to provide protection from external damage and deterioration."

29 CFR  1910.178(p)(1):Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been  taken out of service until restored to safe operating condition(s):  At the worksite located at 3611 Old Route 5, Camdenton, MO, employees were exposed to struck by and fall hazards when a Cat forklift located in the lower shop being used to move material around the shops was found to be missing the Seatbelt and had not been taken out of service until repaired. This was documented on or about 11-1-2024.

29 CFR  1910.179(j)(1)(i):Initial inspection. Prior to initial use all new and altered cranes shall be inspected to insure compliance with the provisions of this section.  At the worksite located at 3611 Old Route 5, Camdenton, MO, employee were exposed to struck by hazards from shop made jib cranes used to hoist material to workstations were not inspection prior to initial use to include load testing. This was documented on 11-1-2023

At the worksite located at 3611 Old Route 5, Camdenton, MO, employee were exposed to electrical shock hazard when extension cords being used to power the jib hoist cranes were found to have damaged insulation with exposed wiring. This was documented on 11-1-2023

29 CFR  1910.303(g)(2)(i):Except as elsewhere required or permitted by Subpart S of Part 1910, live parts of electric equipment operating  at 50 volts or more were not guarded against accidental contact by use of approved cabinets or other forms of approved enclosures or by any of the means identified in paragraphs (A), (B), (C), and (D) of 29 CFR 1910.303(g)(2)(i):  At the worksite located at 3611 Old Route 5, Camdenton, MO, employee were exposed to electrical shock hazard when live wires  were not guarded against accidental contact. This was documented on 11-1-2023 Unguarded wiring was identifed at the following locations:  West wall exposed wiring from a machine that had been disconnected.  In the air compressor room exposed wiring that powers the air compressor.  Junction box on the east wall that runs power to air compressor was not covered and exposed wiring.  East wall exposed wiring from a machine that had been disconnected.
