29 CFR 1926.20(b)(1): The employer did not initiate and maintain accident prevention programs as necessary to comply with this part:  a) Alex Argueta Mendez located at 868 East College Ave Westerville, OH 43081:  On or about October 24, 2023, employees performing roofing work on  a residential home at heights of over 18 feet without fall protection/prevention systems in place and improperly configured ladders. The employer did not initiate and maintain safety and health programs related to the roofing work being conducted.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  a) Alex Argueta Mendez located at 868 East College Ave Westerville, OH 43081:  On or about October 24, 2023, the employer did not instruct employees in the recognition and avoidance of unsafe conditions and the procedures to be followed in order to minimize these hazards. Roofers were removing/installing shingles on a residential roof at heights of over 18 feet with no means of fall protection/prevention systems in place and an improperly configured ladder.

Roofers were removing/installing shingles on a residential roof that varied from 9 to 18 feet without the use of proper fall protection/prevention. The following condition exposed employees to falls of over 18 feet.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a. Alex Argueta Mendez located at 868 East College Ave Westerville, OH 43081:  On or about October 24, 2023, the employer did not ensure that portable ladders used to gain access to the roof extended at least three feet beyond the upper landing that they were using for access.  One extension ladder was used to gain access to roof of the garage was positioned approximately 18 inches beyond the upper landing.  The following condition exposed employees to falls over 9 feet.
