29 CFR  1910.67(c)(2)(v):  A personal fall arrest or travel restraint system that meets the requirements in 29 CFR part 1910, subpart I, shall be worn and attached to the boom or basket when working from an aerial lift.  On or about November 2, 2023, employees were exposed to fall hazards over 6 feet.  Employees were required to move the aerial lift into the shop area from the parking lot in order to provide maintenance.  A personal fall arrest or travel restraint system was not provided, worn or attached to the boom or basket when employees move the aerial lifts.   Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1910.107(g)(3): Residue scrapings and debris contaminated with residue were not immediately removed from the premises and properly disposed. Approved metal waste cans were not provided wherever rags or waste were impregnated with finishing material; and all such rags or waste were not deposited therein immediately after use. The contents of waste cans were not properly disposed of at least once daily or at the end of each shift.  On or about November 3, 2023,  the employer did not ensure that the spray paint residues and debris on the floor surface of the spray booth was removed and disposed of, at least daily.  The floor surface of the spray  booth was covered with large accumulation of residue from the spray painting operations.  Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).

On or about November 3, 2023, employees were exposed to respiratory stressors associated with being allowed to wear 3M 5201 half face respirator while sanding off the body filler from equipment such as powered industrial vehicles and boom lifts, in order to prepare them to be spray painted. The body filler contains crystalline silica.  The employees were not fit tested prior to the initial use of the respirator.    b.
