29 CFR 1926.451(h)(2)(ii):A toeboard shall be erected along the edge of platforms more than 10 feet (3.1 m) above lower levels for a distance sufficient to protect employees below, except on float (ship) scaffolds where an edging of 3/4 x 1 1/2 inch (2 x 4 cm) wood or equivalent may be used in lieu of toeboards; a) On or about November 3, 2023, the employer did not ensure that employees working below the scaffold were protected from overhead falling objects in that toeboard was not installed on the scaffold during masonry operations. An employee was working on the scaffold at approximately 16'8", with employees working on ground level that were exposed to fallings tools and materials.

29 CFR 1926.454(a):The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable: a) On November 3, 2023, the employer did not provide training for employees performing elevated brickwork on a steel tubular scaffold. As a result, two employees were exposed to a fall hazard of approximately 16'8" to the ground below.
