OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to explosion hazards:  (a)  56719 Co Rd 127, NEW RAYMER, CO 80742 - The "lay down, spare yard".: On or around November 1, 2023, and at times prior, employees were exposed to explosion hazards in that the Ring-O-Matic Standard HI-CFM VacEXtreme 850 VX vacuum trailer used to clean flammable liquid spills is not approved to handle flammable liquids.  (b)  56719 Co Rd 127, NEW RAYMER, CO 80742 - The "lay down, spare yard": On or around November 1, 2023, and at times prior, employees were exposed to explosion hazards while attempting to thaw valves on a vacuum trailer using a handheld propane torch.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  (a) 56719 Co Rd 127, NEW RAYMER, CO 80742 - The "lay down, spare yard": On or around November 1, 2023, and at times prior, employees were exposed to explosion hazards in that the employer did not ensure that employees were protected while working with hazardous materials in a Ring-O-Matic Standard HI-CFM VacEXtreme 850 VX vacuum trailer. The Employer failed to develop, implement, and/or maintain at the workplace a written hazard communication program.

29 CFR 1910.1200(f)(10):  The employer did not ensure that workplace labels or other forms of warnings were legible, in English and prominently displaced on the container or readily available in the work area throughout each work shift:  (a) 56719 Co Rd 127, NEW RAYMER, CO 80742 - The "lay down, spare yard": On or around November 1, 2023, and at times prior, employees were exposed to explosion hazards in that the employer did not ensure that Ring-O-Matic Standard HI-CFM VacEXtreme 850 VX vacuum trailer was labeled with warnings about the flammable contents of the trailer. The Employer failed to make sure hazardous material was adequately labeled as required in 1910.1200(f).

29 CFR 1910.1200(g)(9): Where employees must travel between workplaces during a work shift, the employer did not maintain the material safety data sheets in each workplace or at the primary workplace facility where employees can immediately obtain information the required information in the case of an emergency:   (a) 56719 Co Rd 127, NEW RAYMER, CO 80742 - The "lay down, spare yard": On or around November 1, 2023, and at times prior, employees were exposed to explosion hazards in that SDS sheets were not provided to employees for immediate access while working with the Ring-O-Matic Standard HI-CFM VacEXtreme 850 VX vacuum trailer in remote areas of the site. The Employer failed to make Safety Data Sheets available as required in 1910.1200(g).

29 CFR 1910.1200(h)(3)(iii): Employee training did not include the measures employees can take to protect themselves from chemical hazards, including specific procedures the employer had implemented to protect employees from exposure to hazardous chemicals, such as appropriate work practices, emergency procedures and personal protective equipment to be used:   (a) 56719 Co Rd 127, NEW RAYMER, CO 80742- Laydown yard: On or around November 1, 2023, and at time prior, employees were exposed to explosions hazards in that employees were not properly trained to recognize hazardous chemicals and material, or methods used to control these hazards. The Employer failed to provide adequate information and training on measures employees can take to protect themselves as required in 1910.1200(h).
