29 CFR 1926.651(j)(1): Adequate protection was not provided to protect employees from loose rock or soil that could pose a hazard by falling or rolling from an excavation face: a) On or about November 3, 2023, the exposing employer, Ovation Plumbing, Inc., did not ensure employees, who were required to engage in a sewer line repair, were protected from hazards posed by loose rock or soil falling from the face of the excavation. This exposed employees to struck-by and crushing hazards.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions: a) On or about November 3, 2023, the exposing employer, Ovation Plumbing, Inc., did not ensure an inspection of an excavation was made by a competent person for evidence of a hazardous situation that could have resulted in a soil collapse of the excavation walls. By not doing so, employees who were required to engage in sewer line repairs inside of an excavation were exposed to struck-by and crushing hazards.
