29 CFR 1910.1200(e)(1): Employer had not developed or implemented a written hazard communication program included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii).   On or about October 6, 2023, the employer did not develop and implement a written hazard communication program for employees working with and around hazardous chemicals, exposing employees to hazardous chemicals such as but not limited to Masonry Cement containing silica.  Required program elements that were not developed and implemented include the following:  1910.1200(f): Labels and other forms of warning.  1910.1200(g): Safety data sheets.  1910.1200(h): Employee information and training.

29 CFR 1926.1153(i)(1): The employer did not include respirable crystalline silica in the program established to comply with the hazard communication standard (HCS) (29 CFR 1910.1200).  On or about October 6, 2023, the employer did not develop and include respirable crystalline silica into a program for employees working with and around silica, exposing employees to health hazards associated with silica such as but not limited to inhalation hazards.

29 CFR 1926.451(b)(2): Except as provided in paragraphs (b)(2)(i) and (b)(2)(ii) of this section, each scaffold platform and/or walkway was not at least 18 inches (46 cm) wide.  On or about October 6, 2023, an employee was working from a scaffold platform that was not at least 18 inches wide, exposing the employee to a fall hazard.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.  On or about October 6, 2023, employees accessed and egressed a supported scaffold by means of climbing the sides and front of the scaffold which did not contain an approved point of access, exposing the employees to the hazards of falling from a scaffold approximately 13 feet to the ground.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.  On or about November 6, 2023, employees worked from a supported scaffold without being protected by fall arrest or guardrails system, exposing the employees to a fall hazard of approximately 10 feet.

29 CFR 1926.451(h)(1): Each employee on a scaffold was not provided with additional protection from falling hand tools, debris, and other small objects through the installation of toeboards, screens, guardrail systems, or through the erection of debris nets, catch platforms, or canopy structures that contain or deflect the falling objects.  For falling objects too large, heavy or massive to be contained or deflected, the employer did not place and secure such potential falling objects away from the edge of the surface from which they could fall.  On or about November 6, 2023, employees were carrying cement mix buckets and stones to different levels of a scaffold from the ground without being protected from falling objects by use of toeboards or other systems, exposing employees to being struck by tools, stones and equipment.

29 CFR 1926.1053(b)(4): Ladder(s) were used for purposes other than the purpose for which they were designed:  On or about November 6, 2023, employees accessed a scaffold using a Werner portable, free-standing ladder that was closed and leaning against the scaffold system, exposing employees to a fall hazard of up to four feet.
