29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:  Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated   On or about November 3, 2023, and at times thereto, as the controlling and correcting employer, did not ensure a worker/employee installing siding while working inside an elevated aerial lift used at the site was wearing fall protection, exposing the worker/employee to being ejected and unprotected fall hazards of approximately 22-feet to the ground below.

29 CFR  1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:   On or about November 3, 2023, and at times thereto, each worker/employee working inside an elevated aerial lift and exposed to fall hazards was not trained in the Mobile Elevated Work Platform industry required training to recognize and eliminate fall hazards when operating and working from elevated work platforms.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:    On or about November 3, 2023, and at times thereto, a training program was not presented or available with formal training and certification for each employee to understand, recognize and how to eliminate fall hazards and understand how to use fall protection.
