29 CFR 1926.453(b)(2)(v):A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. On or about November 3, 2023, at a work-site located at 303 N Drew Street Appleton, Wisconsin; employees working from a SkyJack Telescopic Boom lift (Model No.: SJ66T, Serial No.: 7060 104361) were not wearing body harnesses and lanyards, exposing those employees to potential falls of greater than 15 feet to the hard surface below. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).

29 CFR 1926.501(b)(1):"Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On or about November 3, 2023, at a work-site located at 303 N Drew Street Appleton, Wisconsin; employees were installing solar panels on the roof of a two-story Victorian-style residence without utilizing a conventional form of fall protection, exposing them to fall hazards greater than 15 feet to the hard surface below.
