Where an employer does representative sampling instead of sampling all employees in order to meet this requirement, the employer shall sample the employee(s) expected to have the highest chromium (VI) exposures.  a.) On or about November 7, 2024, the employer did not conduct initial air monitoring to determine the 8-hour TWA exposure to hexavalent chromium for Maintenance Technicians performing maintenance activities in the work area where employees weld on stainless steel.

Unless a specific occupational safety and health standard provided a different period of time, each employer shall assure the preservation and retention of records as follows: Employee exposure records. Each employee exposure record shall be preserved and maintained for at least thirty (30) years.   a.) On or about November 7, 2023, the employer did not preserve and maintain an exposure record containing the collection methodology (sampling plan), a description of the analytical and mathematical methods used, and a summary of other background data relevant to interpretation of the results obtained for air monitoring conducted on January 14, 2022, to determine hexavalent chromium exposure levels for welders working in the employer's regulated area.
