29 CFR 1926.1053(b)(1): Where a portable ladder(s) was used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder. (a) On or about November 7, 2023, the Werner Extension ladder erected on the West side of the structure, at the garage that was being used for access to the 6:12 pitched roof, did not extend at least three (3) feet above the eave, and/or was not secured to the structure when it was not sufficiently extended. This exposed employees accessing the roof to a fall hazard of approximately nine (9) feet. (b) On or about November 7, 2023, the Werner Extension ladder erected on the West side of the structure, above the garage that was being used for access to the 2nd floor 6:12 pitched roof, did not extend at least three (3) feet above the ridge, and/or was not secured to the structure when it was not sufficiently extended. This exposed employees accessing the roof to a fall hazard of approximately nine (9) feet followed by a second fall hazard of an additional nine feet (9) to the ground level.

29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: (a) On or about November 7, 2023, the employer did not ensure that the employee assisting in roofing operations (ground worker) was protected from potential falling objects from above by the use of a protective helmet. This exposed the employee to a struck-by hazard from a height of nine (9) feet by material remnants and tools above the working employee. Nass Roofing, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.100(a), which was contained in OSHA inspection number 1536800, citation number 1, item number 1, and was affirmed as a final order on 06-13-2022, with respect to a workplace located at 947 Leverenz Road, Naperville, IL., 60565.
