Except as otherwise provided in paragraph (b) of this section, each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.   a)  On or about November 7, 2023, at 2310 E Main Street in Kaukauna, Wisconsin, an employee was exposed to fall hazard working on a roof 20 feet above surface level without using required fall protection equipment.  Roof caulking within 10 feet of roof edges.  b)  On or about November 7, 2023, at 2310 E Main Street in Kaukauna, Wisconsin, an employee was exposed to fall hazard working on a roof 20 feet above surface level without using required fall protection equipment.  Roofing paper and debris clean-up.

29 CFR  1926.502(f)(1):  Warning line systems.  The warning line shall be erected around all sides of the roof work area.   On or about November 7, 2023, at 2310 E Main Street in Kaukauna, Wisconsin, employees were exposed to a fall hazard working on a roof surface 20 feet above surface level using a warning line without installing the line in a complete system around the work area.  Warning lines were installed on two sides of the work area.

Points of access, materials handling areas, storage areas, and hoisting areas shall be connected to the work area by an access path formed by two warning lines.  On or about November 7, 2023, at 2310 E Main Street in Kaukauna, Wisconsin, employees were exposed to a fall hazard while using a roof access/egress ladder walking between a roof warning line and the roof edge 20 feet above surface level without warning lines installed as a path to the ladder.

29 CFR  1926.502(f)(3):  Warning line systems.  No employee shall be allowed in the area between a roof edge and a warning line unless the employee is performing roofing work in that area.   On or about November 7, 2023, at 2310 E Main Street in Kaukauna, Wisconsin, an employee was exposed to a fall hazard working between a warning line and a roof edge 20 feet above surface level without using fall protection equipment.  Employee was providing hand signals to a forklift operator.

The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used.  On or about November 7, 2023, at 2310 E Main Street in Kaukauna, Wisconsin, the employer did not provide required fall protection safety training for employees who were exposed to fall hazards greater than six feet while installing roofing materials.

29 CFR  1926.602(d):  Powered industrial truck operator training. Note:  The requirements applicable to construction work under this paragraph are identical to those set forth at ��1910.178(l) of this chapter. 29 CFR 1910.178(l)(1)(ii):  Safe Operation.  Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer shall ensure that each operator has successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5).  On or about November 7, 2023, at 2310 E Main Street in Kaukauna, Wisconsin, the employer did not provide the required powered industrial truck operator training prior to an employee operating a Caterpillar TL943C Telescopic Forklift during roofing work.  Forklift used to remove materials and equipment from roof edge 20 feet above surface level.
