29 CFR 1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6): a) On or about October 31, 2023, at the facility located at 5900 County Road NN, Denmark, Wisconsin; the employer failed to ensure employees effectively locked out the ACE Equipment Baler (Model No.: JB 8018.102, Serial No.: E-22BG-US0072904) while conducting troubleshooting activities, exposing then to live electrical current. b) On or about March 14, 2024, at the facility located at 5900 County Road NN, Denmark, Wisconsin; employees were exposed to potential caught in hazards from rotating shafts during door gasket changing operations on Drain Tables 1-12. The task being performed was routine, repetitive, and integral to normal production operations, but effective protective measures were not in place and allowed the employees performing the service and maintenance task to be exposed to the hazard. As a result, the remaining applicable energy control elements, involving machine isolation [1910.147(d)(3)], lockout/tagout device application [1910.147(d)(4)], dissipation of residual energy [1910(d)(5)(i)], and verification of isolation [1910.147(d)(6)] were not implemented to protect employees from machine hazards.

29 CFR 1910.147(f)(3)(ii)(D): Each authorized employee shall affix a personal lockout or tagout device to the group lockout device, group lockbox, or comparable mechanism when he or she begins work, and shall remove those devices when he or she stops working on the machine or equipment being serviced or maintained. On or about February 12, 2024, the employer did not ensure that each employee conducting sanitation on the Mixer/Cooker #10 applied a personal energy control device to a group lockout before conducting the activity, potentially exposing them to machine hazards.

29 CFR 1910.151(c): Where the eyes or body of any person may be exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body shall be provided within the work area for immediate emergency use. Reference: ANSI Z358.1 Emergency Eyewash and Shower Standard On or about December 20, 2023, at the facility located at 5900 County Road NN, Denmark, Wisconsin; employees working on the Vat Decks were exposed to injurious corrosive chemicals and were not provided with suitable facilities for quick drenching of the eyes and body. Specifically, employees using chemicals such as, but not limited to, lactic acid and Enforce LP, where not provided with a suitable means of flushing their eyes on the same level the chemicals were being used.

On or about January 23, 2024, at the facility located at 5900 County Road NN, Denmark, Wisconsin; employees working at the box loading station of the metal detector conveyor of Packaging Line #6 were exposed to potential entanglement hazards when the rotating end of the conveyor drive shaft did not present a smooth edge.
