29 CFR 1910.242(a): General requirements. Each employer shall be responsible for the safe condition of tools and equipment used by employees, including tools and equipment which may be furnished by employees. On or about November 7, 2023, and at times prior, the employer failed to ensure that special handtools for placing and removing material were used in lieu of other guarding required by 29 CFR 1910.212 exposed employees to caught-in hazards. The raking tool used to clear waste material was used to bypass the machine guarding resulting in an employee injury.
