This condition exposed an employee to respirable crystalline silica during sawing operations.

This condition exposed employees to respirable crystalline silica while conducting concrete sawing operations.

29 CFR 1926.1153(i)(2)(i): The employer did not ensure that each employee covered by this section could demonstrate knowledge and understanding of the health hazards associated with exposure to respirable crystalline silica: (a)Dakota Concrete Service, LLC at 5416 Huntwood Avenue, Sioux Falls, SD 57108: On or about November 8, 2023, the employer did not ensure that employees who were using the Stihl T5 500i cutting saw understood the health hazards associated with cutting operations and the effects of respirable crystalline silica and/or methods such as, but not limited to, engineering controls, work practices or personal protective equipment ("PPE"). This condition exposed employees to health hazards associated with respirable crystalline silica.
