OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that they were exposed to struck-by and crushed-under hazards due to falling loads and elements from a damage storage rack system. a. Holtz Industries Inc., located at 200 South Terrace Court, Newark, Ohio 43055: On or about November 08, 2023, employees were exposed to struck-by and crushing hazards when they conducted warehouse tasks around the pallet rack storage systems damaged from forklift impacts. The storage racking systems had bent/deflected upright columns in the aisleways that included, but were not limited to K-Row, KK Row, R-Row, S-Row, U-Row and Y-Row.

Bags, containers, bundles, etc., stored in tiers shall be stacked, blocked, interlocked and limited in height so that they are stable and secure against sliding or collapse. a. On or about November 08, 2023 and days prior, the employer did not ensure that several unstable wooden crates stored on the storage racking systems of the KK row were secured and stable to prevent the stored crates and/or materials from falling to the aisleway below, thereby exposing employees to struck-by and/or crushed-by hazards. b. On or about November 08, 2023 and days prior, the employer did not ensure that several unstable pallets with metal rod parts stored on the storage racking systems of the K row were secured and stable to prevent the stored materials from falling to the aisleway below, thereby exposing employees to struck-by and/or crushed-by hazards.
