29 CFR  1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s)   (a) On or about November 7, 2023, the employer did not ensure the competent person was conducting frequent and regular inspections of the job site, to ensure fall protection was being worn, that fall protection systems were installed properly and job site conditions were maintained safe.

29 CFR  1926.451(b)(7): On scaffolds where platforms were overlapped to create a long platform, the overlap did not occur only over supports, and was less than 12 inches (30 cm) when the platforms were not nailed together or otherwise restrained to prevent movement.  (a) On or about November 7, 2023, employees were exposed to a fall hazard of approximately 21 feet to the ground while working  from a pump jack scaffold with platforms that were not properly installed.  The platforms were  connected together with a ratchet strap to extend the length of the platform, did not overlap over a support, and did not overlap each platform end at least 12inches.

29 CFR  1926.451(g)(4)(i): Guardrail systems were not installed along all open sides and ends of platforms before being released for use by employees other than erection/dismantling crews:  (a) On or about November 7, 2023, employees working from a pump jack scaffold were not protected from falling to the lower level by a guardrail system along all open sides. This exposed employees to a 21 foot fall hazard to the ground below.

29 CFR  1926.451(h)(2)(ii): A toe-board was not erected along the edge of platforms more than 10 feet (3.1 m) above lower levels for a distance sufficient to protect employees below:  (a) On or about November 7, 2023, the employer did not insure that a toe board was installed along the edges of the pump jack scaffold work platform.  This exposed employees working below to a struck by hazard.

(a) On or about November 7,2023, the employer did not ensure that all employees involved in erecting, disassembling, moving, operating, repairing, maintaining, or inspecting the Werner pump jack scaffold had been trained to recognize and address the hazards associated with this scaffold and how to reduce or eliminate those hazards prior to use of the scaffold.

29 CFR 1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  (a)On or about November  7, 2023, the employer did not insure employees were trained to recognize the fall hazards they were exposed to, nor that employees were properly trained to utilize the proper fall protection provided for the tasks they were performing. This exposed employees to a fall hazard.
