29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.(a) a. On or about November 6, 2023, the portable ladder used to access the roof did not extend at least three (3') feet above the upper landing surface nor was it secured at the top, thereby exposing employees to the hazards associated with falls.

29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation. a. On or about November 6, 2023, at the above addressed jobsite, an employee using a pneumatic nail gun was not utilizing eye protection, thereby exposing the employee to hazards associated with eye injuries. The Peter Badovsky Construction, Inc. was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1, citation number 1, item number 1669742 and was affirmed as a final order on August 3, 2023, with respect to a workplace located at 5100 Dobson St, Skokie, IL 60077.
