29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE):  On or about November 8, 2023, and at times prior thereto, workplace hazard assessments were not conducted to determine if hazards were present and to determine the necessary PPE, such as but not limited to while building a Battery Storage Unit, employees were exposed to arc flash hazards.

29 CFR 1910.137(c)(2)(viii): Electrical protective equipment was not periodically electrical tested. Test voltages and the maximum intervals between tests will be in accordance with Table I-4 and Table I-5.  On or about November 9, 2023, and at times prior thereto, the employer did not ensure that insulated electrical rubber gloves were tested every six months. Rubber gloves last tested April 2022.

29 CFR 1910.333(c)(2): The employer did not ensure that only qualified persons were working on energized circuits and that qualified persons were familiar with the proper use of special precautionary techniques, personal protective equipment, insulating and shielding materials, and insulated tools.  On or about November 8, 2023, and at times prior thereto, the employer did not ensure employees who built an 850-volt battery storage unit were qualified and familiar with special precautionary techniques to work on particular units exposing them to electrical shock and arc flash burn hazards.

29 CFR 1910.335(a)(1)(i): Employees working in areas where there are potential electrical hazards were not provided with, and did not use, electrical protective equipment that is appropriate for the specific parts of the body to be protected and for the work to be performed.     Note - Personal protective equipment requirements are contained in subpart I of this part.  On or about November 8, 2023, and at times prior thereto, and at times thereafter, the employer did not ensure employees were provided and wore electrical personal protective equipment when building battery storage units for delivery.  Employees were exposed to electrical shock and arc flash hazards.
