29 CFR 1926.452(w)(6)(i): Employees were allowed to ride on scaffolds when the surface on which the scaffold was moved was not within 3 degrees of level, and/or not free of pits, holes, and obstructions:  a)Kennebec Telephone Co., Inc., dba PowerCom Electric & Communications at 24931 Thunderstick Road, Chamberlain, SD 57325: On or about and at times prior to November 4, 2023, the employer allowed employees to ride on the S-Mac scissor lift, model KC65 when the surface on which the lift was moved was not within 3 degrees of level, and/or not free of pits, holes, or obstructions.  This condition exposed employees to fall hazards greater than 10 feet due to the instability of the lift system and resulted in the lift tipping.

29 CFR  1926.451(g)(4)(ii): The top edge height of top rails on scaffolds manufactured or placed in service after January 1, 2000 were not installed between 38 and 45 inches above the platform surface and installed between 36 and 45 inches above the platform surface on scaffolds manufactured or placed in service before January 1, 2000:    a)Kennebec Telephone Co., Inc., dba PowerCom Electric & Communications at 24931 Thunderstick Road, Chamberlain, SD 57325: On or about and at times prior to November 4, 2023, the employer did not ensure the top edge height of the top rail on an  S-Mac Model KC65 Scissor Lift was between 38 and 45 inches.  This condition exposed employees to fall hazards greater than 10 feet.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards:  a)Kennebec Telephone Co., Inc., dba PowerCom Electric & Communications at 24931 Thunderstick Road, Chamberlain, SD 57325: On or about and at times prior to November 4, 2023, the employer did not ensure employees who performed work on a S-Mac Model KC65 Scissor Lift were trained by a qualified person to recognize and minimize hazards associated with the type of scaffold being used prior to use.  This condition exposed employees to struck-by and fall hazards greater than 10 feet.
