29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: Location: Post Harvest Trim Room. 24 Munsonhurst Road. Franklin, New Jersey 07416 a) The employer did not administer a hearing conservation program for employees in the Post Harvest Trim Room that included all provisions required in the standard. On February 21, 2024, five employees in the Post Harvest Trim Room working near the Mobius M108S Trimming Machine were exposed to noise levels above the 10 hour time weighted average of 82.1dBA. Employees were exposed to noise levels of 89.4dBA, 87.4dBA, 84.4dbA, 83.2dBA, and 83.5dBA respectively. Employees were sampled for 386 minutes, 388 minutes, 380 minutes, 383 minutes, and 243 minutes. Zero exposure is assumed for the unsampled periods of 94 minutes, 92 minutes, 100 minutes, 97 minutes, and 237 minutes. Violation occurred on or around February 21, 2024.
