29 CFR  1926.1153(e)(2):  Where respirator use is required by this section, the employer did not institute a respiratory protection program in accordance with 29 CFR 1910.134:   On or about November 14, 2023, the employer did not fully institute a respiratory protection program when respiratory protection was required by this section. For employees required to wear tight-fitting, filtering-facepiece N95 respirators, the employer failed to provide medical evaluation for respirator use and appropriate fit-testing of respirators.

29 CFR  1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section:  On or about November 14th, 2023, the employer did not fully and properly implement the protections specified in Table 1 where employees utilized an "EZ Drill" dowel drilling rig to drill into the side of a concrete slab. The dowel drilling rig was not equipped with the functioning shroud around the drill bit with a dust collection system that Table 1 requires for dowel drilling rigs for concrete.  In the alternative:  29 CFR 1926.1153(d)(2)(i):  The employer did not assess the exposure of each employee who was or may have been reasonably expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2)(ii) or the scheduled monitoring option in paragraph (d)(2)(iii) of this section:  On or about November 14th, 2023, where the employer attempted and failed to fully and properly implement the engineering controls described in Table 1, the employer also failed to assess the exposure of each employee engaged in the operation of the dowel drilling rig.
