29 CFR 1926.102(a)(1): Personal Protective & Life Saving Equipment.  The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.   626 E. Main Street: On or about November 14, 2023, Employer did not protect Employee(s) from accidental injury by providing Employees appropriate eye or face protection when exposed to eye or face hazards from flying particles. Employee(s) were performing roof removal-repair-replace activities on an 12-12 pitch wooden-metal roof over 20-feet above ground without any eye protection while using pneumatic nail guns .

29 CFR 1926.501(b)(13):   Fall Protection  - Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision.  626 E. Main Street: On or about November 14, 2023, Employer did not protect Employee(s)from accidental injury while engaged in residential construction activities 6-feet or more above lower levels. Employee(s) were performing roof removal-repair-replace activities on a 12-12 pitch roof atop a 3-story, multi-family structure, more than 20-feet above ground level without a guardrail system, safety net system or personal fall arrest system, nor were employee(s) provided with and alternative fall protection measure under another provision. Employee had only 2x kneeboards in place for protection at nearly 25-feet from the ground, sidewalk, and box truck below.

29 CFR 1926.1053(b)(1):   Ladders - When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support  626 E. Main Street: On or about November 14, 2023, Employer did not protect Employees from accidental injury by ensuring portable ladders used to access an upper landing surface , had ladder side rails extending at least 3-feet above the upper landing surface to which the ladder was used by Employees to gain access. Employee(s) were identified performing roof removal-repair-replace activities on a 12-12 pitch roof atop a 3-story, multi-family structure utilizing portable ladders that did not have side rails extending at least 3-feet above the upper landing surface.
