On or about November 14, 2023, Marathon El Paso refinery, the employer did not develop and implement operating procedures that provide clear instructions for cold startup following emergency shutdown of the Crude Unit #6. This condition exposed employees to a potential H2S exposure hazard.

29 CFR 1910.1000(e): Feasible administrative or engineering controls were not determined and implemented to achieve compliance with the limits prescribed in 29 CFR 1910.1000(a) through (d): On or about November 15, 2023, and at times prior thereto, at the Marathon Petroleum refinery, where administrative or engineering controls were not feasible to achieve full compliance employee exposure to Hydrogen Sulfide (H2S) exceeded the exposure limits specified as acceptable ceiling concentration limits for H2S. This condition exposed employees to health hazards such as inhalation and suffocation hazards brought on by acute exposure to hydrogen sulfide gas.
