29 CFR 1910.140(c)(10)(v): The employer did not ensure that fall protection system snap-hooks and carabiners are not connected to any object that is incompatibly shaped or dimensioned in relation to the snap-hook or carabiner such that unintentional disengagement could occur when the connected object depresses the snap-hook or carabiner gate, allowing the components to separate, unless they are designed for such connections. (a) On November 6th, 2023, while replacing vinyl on Newman Sign number 4469 located near 37th St SE Mapleton, North Dakota, an employee fell over 25 feet after connecting his fall protection snap-hook to the metal grating of the walkway which was not designed to be used as an anchor point and prevented the snap-hook from connecting fully and arresting the fall.

29 CFR 1904.39(a)(2): The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye. (a) on November 6th, 2023, at or near 4469 on 37th St SE Mapleton, North Dakota, a hospitalization was not reported to OSHA within 24 hours after an employee fell over 25 feet from a billboard and was hospitalized.
