29 CFR 1910.176(a):Use of mechanical equipment. Where mechanical handling equipment is used, sufficient safe clearances shall be allowed for aisles, at loading docks, through doorways and wherever turns or passage must be made. Aisles and passageways shall be kept clear and in good repair, with no obstruction across or in aisles that could create a hazard. Permanent aisles and passageways shall be appropriately marked. a) On or about 11/10/2023 in the docking area of the shipping department, the employer did not ensure that the aisles utilized by the forklifts to load and unload trucks, maintained a sufficient safe clearance in that pedestrians were exposed to struck-by hazards due to chemical drums being stacked three high in walkways causing a blind spot where powered industrial vehicles were operated. CSHO last observed the hazard on 11/16/2023 (day of the opening), boxes continued to be stacked creating a blind spot.

(ii)(B) The operator has been involved in an accident or near-miss incident; a) On or about 11/16/2023 the employer did not re-certify forklift operators following an accident involving a pedestrian being struck by a forklift resulting in injuries on 11/10/2023.

29 CFR 1910.178(n)(4):The driver shall be required to slow down and sound the horn at cross aisles and other locations where vision is obstructed. If the load being carried obstructs forward view, the driver shall be required to travel with the load trailing. a) On 11/10/2023 the employer did not ensure that powered industrial truck operators operating equipment such as but not limited too; a Komat'su Forklift (Model #FB25SHH-5) sounded the horn, alerting pedestrians in areas where blind spots were created due to excess product being stored 10' in height at the intersection across from the office.
