The employer must ensure: (8) The cap (if equipped) and top step of a stepladder are not used as steps. a) On or about November 15, 2023, the employer did not ensure that employees were not using the top step of a 17 Little Giant Leveler ladder as a step. As a result, employees were exposed to a fall height of 6 feet. b) On or about November 15, 2023, the employer did not ensure that employees were not using the top step of a Werner 14 Foot Multi-Position Ladder as a step. As a result, employees were exposed to fall height of 6 feet.

(i) Except as provided elsewhere in this section, the employer must ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the following: (A) Guardrail systems; (B) Safety net systems; or (C) Personal fall protection systems, such as personal fall arrest, travel restraint, or positioning systems. a) On or about November 15, 2023, the employer did not ensure that employees replacing holiday lighting on a commercial roof with unprotected sides and edges were utilizing a fall protection system. As a result, employees were exposed to a fall height measured at 12'6".

29 CFR 1910.30(a)(3): Fall hazards. The employer must train each employee in at least the following topics: (i) The nature of the fall hazards in the work area and how to recognize them; (ii) The procedures to be followed to minimize those hazards; a) On or before November 15, 2023, the employer did not ensure that employees were trained on the fall hazards and how to minimize those hazards while performing work on roofs in that they were not utilizing a fall protection system while changing lights on a roof. As a result, employees were exposed to a fall height of 12'6".
