OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to caught between and/or struck-by hazards: a) Godfrey and Wing Inc. located at 1400 Summit Street, Toledo, Ohio, 43604: On or about November 16, 2023, a below-the-hook lifting device attached to the hook of the Gorbel 250 jib used to load and unload product at the API machine did not maintain an identification plate or any other means to indicate the lifting device's lifting capacity, thereby exposing the employees to a struck-by and/or caught between hazard.

Summit Street, Toledo, Ohio, 43604: On or about November 16, 2023, the employer failed to provide a workroom floor, located around the CFI area, that was maintained in a clean and dry condition. The floor surrounding the CFI machine where wet processes are used had wet and slippery floors with areas of standing water present exposing employees to slip and fall hazards.

Summit Street, Toledo, Ohio, 43604: On or about November 16, 2023, the employer failed to ensure that a hazard assessment identifying and selecting appropriate personal protective equipment was conducted prior to employees engaging in activities such as mixing catalyst with other resin chemicals to create impregnation sealant compound. Employees were exposed to hazards associated with chemicals such as, but not limited to, Hydroxypropyl Methacrylate, triethylene glycol dimethacrylate and lauryl methacrylate that could result in eye, skin, respiratory irritation and other hazardous health effects.

Employees tasked with performing service and maintenance tasks such as, but not limited to, troubleshooting, replacing sensors and water pumps on the CFI machine without the benefit of energy isolation, hazardous energy recognition training and employer evaluation, exposed employees to potential struck-by hazards created by the unexpected energization of the equipment.

Summit Street, Toledo, Ohio, 43604: On or about November 16, 2024, the employer failed to ensure that each employee tasked with operating powered industrial vehicles such as, but not limited to, the propane fueled Yale Veracitor 50VX (Model: GLC050VXNEAE083) were adequately trained through a combination of formal instruction, practical training and evaluation prior to operating the powered industrial vehicles throughout the facility. Powered industrial vehicle operators and pedestrians were exposed to potential struck-by and crushing hazards in that employees operated the vehicles without the benefit of the required training.
