29 CFR  1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment were used to support scaffold platforms when they were not specifically designed by the manufacturer for such use:   a) At or near 51 Queen Anne Rd, Bogota NJ -  Exterior: Employees engaged in window installation activities were exposed to an approximately 30 feet fall hazard as they worked from a wooden box supported by an Ingersoll-Rand VR-1044 All Terrain Forklift, on or about 11/16/23.

29 CFR 1926.602(c)(1)(vi): Industrial truck(s) in use did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks.  a) At or near 51 Queen Anne Rd, Bogota NJ -  Exterior:  An Ingersoll - Rand VR-1044 All Terrain Forklift  with the hoisting boom extended  supporting a wooden box utilized as a scaffold platform sustaining employees engaged in window installation activities was left unattended , on or about 11/16/23.

29 CFR  1926.602(d):The employer did not ensure that each employee operating a powered industrial vehicle had been trained and evaluated as required by paragraph 29 CFR 1910.178(l):Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178.  and as referenced by the note contained in 1926.602(d).   a) At or near 51 Queen Anne Rd, Bogota NJ -  Exterior: Employee that had not been evaluated and certified by the employer in the safe operation of forklifts had utilized an All Terrain Forklift to lift a job made box with 2 workers engaged in window installation, on or about 11/16/23.

29 CFR  1926.1052(b)(1): Where the treads and/or landings of pan stairs were to be filled in with concrete or other material at a later date, foot traffic was not prohibited on the stairway:   a) At or near 51 Queen Anne Rd, Bogota NJ -  Interior North Stairway - 4 levels: Employees were exposed to fall hazards of approximately 15 feet while engaged in window installation utilizing a steel stairway that had not been filled with concrete nor wood on all 4 levels, on or about 11/16/23.
