29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift: (a) On or about November 17, 2023, an employee was installing sheathing to the third story of a multi-story residential property, from the basket of a Genie, Model S-85 XC, telescopic boom lift and was not wearing fall protection. This hazard exposed the employee to a fall of approximately 25 feet. (b) On or about November 17, 2023, two employees were installing flashing tape to multi-story residential property, from the basket of a JLG, Model 860SJ, telescopic boom lift and were not wearing fall protection. This condition exposed employees of injuries associated with falls from heights of approximately 19.5 feet.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: (a) On or about November 17, 2023, the employer did not ensure that each employee engaged in installation of siding operations were trained to recognize the hazards of working at elevation and trained in the use of fall protection. Two employees did not utilize fall protection when utilizing a JLG, Model 860SJ, telescopic boom lift, as they installed flashing tape to multi-story residential property. This condition exposed employees of injuries associated with falls from heights of approximately 19.5 feet.
