29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s):  a)  On or about November 16, 2023, Reed Illinois Corporation dba Reed Construction, did not assign a competent person to conduct onsite inspections where subcontractor employees were exposed to the hazards associated with the demolition operations including fall hazards, impalement hazards, and struck-by hazards.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.1101(d)(5): As supervisor of the entire project, the general contractor did not ascertain whether the asbestos contractor was in compliance with the asbestos standard, and did not require such contractor to come into compliance with this standard:    a) On or about November 16, 2023, Reed Illinois Corporation dba Reed Construction, did not ascertain whether its demolition subcontractor K.L.F. Enterprises, Inc. was compliant with the 1926.1101 OSHA asbestos regulations, and did not require its subcontractor to come into compliance at the 2615 Washington St., Waukegan, IL 60085 worksite.  By removing fireproofing insulation sprayed on structural beams, which contained 15% chrysotile asbestos, K.L.F. Enterprises, Inc., assumed the role of an asbestos abatement contractor, and exposed their employees to the hazards associated with asbestos.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
