29 CFR 1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): On or about November 15, 2023, employees engaged in residential construction activities were exposed to fall hazards while working from heights above 6-feet without fall protection. Cuates Ramirez Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1634168, citation number 1, item number 1 and was affirmed as a final order on December 27, 2022, with respect to a workplace located at 2428 Mike Price Dr., El Paso, TX 79938.

29 CFR 1926.503(c)(3): Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill. On or about November 15, 2023, employees engaged in residential construction operations were exposed to fall hazards in excess of 6-ft. due to the employees using a personal fall arrest system in a manner indicating they did not have the understanding or skill required on how to minimize fall protection hazards. Cuates Ramirez Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.503(c)(3), which was contained in OSHA inspection number 1634168, citation number 2, item number 1 and was affirmed as a final order on December 27, 2022, with respect to a workplace located at 2428 Mike Price Dr. El Paso, TX 79938.
