OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees from hazards associated with struck by hazards: a) Meat and Seafood Department, RD United, LLC at 1740 West 13th Avenue Denver, CO 80204: On or about November 17, 2023, and at times prior, employees were exposed to a struck by hazards while working in and around storage racks that were not securely fastened to the floor. b) Outside Loading Dock Area, RD United, LLC at 1740 West 13th Avenue Denver, CO 80204: On or about November 17, 2023, and at times prior, employees were exposed to a struck by hazards while working in and around storage racks that were not securely fastened to the floor. c) Produce Storage, RD United, LLC at 1740 West 13th Avenue Denver, CO 80204: On or about November 17, 2023, and at times prior, employees were exposed to struck by hazards while working in and around industrial steel storage racks that had damaged cross braces.

29 CFR 1910.151(c): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use: a) RD United LLC at 1740 W 13th Ave, Denver, CO 80204: On or about November 17, 2023, and at times before, employees were exposed to hazards associated with lack of access to an emergency eyewash facilities, in that, the emergency eyewash station in the dock area was clocked off by pallets and completely inaccessible.
