29 CFR 1910.95(c)(1):The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: In the following instances, employees were exposed to noise levels exceeding an 8-hour time weighted average of 85 decibels measured on the A scale, or equivalently a dose of fifty percent, and the employer did not have a hearing conservation program: a. A film operator, in the older production building, was exposed to continuous noise at 113.3% of the daily noise exposure (8-hour time-weighted average sound level of 85 dBA) or an equivalent sound level of approximately 90.9 dBA during the 433-minute sampling period on November 20, 2023; exposure calculations included a zero increment for the 47 minutes not sampled. b. A machine operator, in the reprocess room, was exposed to continuous noise at 95.1% of the daily noise exposure (8-hour time-weighted average sound level of 85 dBA) or an equivalent sound level of approximately 89.6 dBA during the 461-minute sampling period on November 20, 2023; exposure calculations included a zero increment for the 19 minutes not sampled. c. A machine operator, in the reprocess room, was exposed to continuous noise at 80.4% of the daily noise exposure (8-hour time-weighted average sound level of 85 dBA) or an equivalent sound level of approximately 88.4 dBA during the 460-minute sampling period on November 20, 2023; exposure calculations included a zero increment for the 20 minutes not sampled.
