29 CFR 1926.501(b)(13):Employee(s) engaged in residential construction 6 feet (1.8 m) or more above lower levels were not protected from falling by the use of guardrail systems, safety net systems or personal fall arrest systems nor was an alternative fall protection plan which meets the requirements of 1926.502(k) developed and implemented: On or about November 20, 2023, and at times prior thereto, employees were installing joists and trusses to an apartment complex under new construction without using a fall protection system, exposing the employees to a fall hazard of approximately 10 feet. Agricolo Aguirre was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(1), which was contained in OSHA inspection number 1585155, citation number 1, item number 1 and was affirmed as a final order on 06/01/2022, with respect to a workplace located at 21915 Us Hwy 281 San Antonio, TX 78258.
