OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the recognized hazard of working from an elevated platform with a guardrail system that was designed such that is had gaps large enough for a sphere of nineteen (19) inches in diameter could pass through it creating a possibility of employees falling to the walking-working surface below: (a) Cultivation Department - On or about November 21, 2023, employees working from elevated platforms while cultivating cannabis plants were exposed to a fall hazard of approximately five (5) feet because the chain system used for guardrails at either end of the platforms were designed such that a sphere of nineteen (19) inches in diameter could pass through it. Abatement Certification Required.

OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the recognized hazard of electrical outlets that were not equipped with a faceplate creating a possibility of employees receiving electrical shocks when using the outlets: (a) On or about November 17, 2023, employees working in Grow Room 3 were exposed to shock hazards because numerous electrical outlets were not installed with faceplates. Abatement Certification Not Required.

OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the recognized hazard of an emergency exit access being less twenty-eight (28) inches in width exposing employees to the potential of smoke inhalation and burns when evacuating the area in an emergency: (a) Grow Room 3 - On or about November 21, 2023, employees working in Grow Room 3 were exposed to a fire hazard because the width between grow tables leading to the exit was measured to be restricted to widths ranging from nineteen and a half (19.5) inches to twenty-seven (27) inches at points. (b) Grow Room 4 - On or about November 21, 2023, employees working in Grow Room 4 were exposed to a fire hazard because the width between grow tables leading to the exit was measured to be restricted to widths ranging from fourteen (19.5) inches to twenty-four (24) inches at points. (c) Grow Room 9 - On or about November 21, 2023, employees working in Grow Room 9 were exposed to a fire hazard because the width between grow tables leading to the exit was measured to be restricted to twenty-four (24) inches in width. Abatement Certification Required.
