29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a. Located at Lot 30, 7605 Steeplechase Lane New Albany, Ohio 43054: On or about. November 20, 2023, the employer failed to ensure the employees were wearing appropriate eye protection while operating circular saws and pneumatic nail guns to cut and install siding materials on a new build home.

29 CFR 1926.451(f)(7): Scaffolds shall be erected, moved, dismantled, or altered only under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration. Such activities shall be performed only by experienced and trained employees selected for such work by the competent person.  a. Located at Lot 30, 7605 Steeplechase Lane New Albany, Ohio 43054: On or about November 20, 2023, the employer did not ensure that the scaffold being used for residential siding installation was erected under the supervision and direction of a competent person qualified in the building of the scaffold system.

29 CFR  1926.451(g)(1):Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers. Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part.  a. Located at Lot 30, 7605 Steeplechase Lane New Albany, Ohio 43054: On or about November 20, 2023, the employer failed to ensure the employees working off of a ladder jack scaffold plank that was above 10 feet from the ground level were protected from falling when installing house siding material on a two-story single-family home. The employees were exposed to a fall of approximately 18 feet from the edge of the scaffold platform to the ground below.

29 CFR 1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.  a. Located at Lot 30, 7605 Steeplechase Lane New Albany, Ohio 43054: On or about November 20, 2023, the employer failed to ensure that the employees were properly protected from falling while installing siding material on a two-story single-family home. The employees were exposed to a fall of up to approximately 12 feet from the roofs edge to the ground below.
