29 CFR 1917.112(a)(2):The provisions of paragraph (a)(1) of this section also apply at the edge of any fixed level above the common floor area from which vehicles may fall, except at loading docks, platforms and skids where cargo is moved by vehicles. Reference: 29CFR 1917.112(a)(1) Vehicle curbs, bull rails, or other effective barriers at least six inches (15.24 cm) in height shall be provided at the waterside edges of aprons and bulkheads, except where vehicles are prohibited. Curbs or bull rails installed after October 3, 1983, shall be at least 10 inches (25.4 cm) in height. a) Brennan Terminal Barge : On or about 11/21/2023 and at times prior, the employer exposed third party contractors to a fall/struck by hazard to vehicle operators of falls of over 4 feet, in that the ramp used to gain vehicle access to the barge did not have curbs or bull rails.

29 CFR 1917.45(f)(10)(i): At least one portable fire extinguisher of at least 5 - BC rating or equivalent shall be accessible in the cab of the crane or derrick. a) Brennan Terminal Barge : On or about 11/21/2023 and at times prior, the fire extinguisher was not charged from the Grove RT530E (SN#221526 ) while in operations lifting barge covers off of barges, exposing an employee to a fire hazard.
