29 CFR 1926.1153(d)(1): The employer did not ensure that employees were not exposed to an airborne concentration of respirable crystalline silica in excess of 50 micrograms per cubic meter, calculated as an 8-hour TWA:  a)  At the Lake Miona Regional Recreational Complex Sports Pool, on or about November 27, 2023, an employee working as a cutter was exposed to Crystalline Silica at an 8-hour Time Weighted Average (TWA) of 63.89 micrograms per cubic meter, 1.278 times the limit of 50.0 micrograms per cubic meter while cutting pool tiles using an angle grinder. The sampling was performed during one shift on November 27, 2023.  The exposure level was derived from one sample collected over a 41-minute sampling period. Zero exposure was assumed for the remaining 439-minutes.

29 CFR  1926.1153(d)(2)(i): The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2)(ii) or the scheduled monitoring option in paragraph (d)(2)(iii) of this section:  a) At the Lake Miona Regional Recreational Complex Sports Pool, which is located at 1526 Buena Vista Blvd, The Villages, Florida 32162, employees dry cutting tile were exposed to crystalline silica in excess of the permissible exposure level, in that, the employer failed to conduct an  assessment of each employee 8-hour TWA exposure.
