Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure: On or about November 9, 2023 and at times prior to, employees worked on the second level of a resident while exposed to an unprotected side opening with construction material on the floor to cause trip hazards near the opening. This exposed employees to fall hazards greater than ten feet to the ground.

29 CFR 1926.1053(b)(4): Ladders were used for purposes other than the purposes for which they were designed: On or about November 9, 2023, and at times prior to, employees worked from a scaffold and used an A Frome ladder for access and egress. The A frame ladder was folded and leaned against the scaffold support when used to access the scaffold, and exposed employees to fall hazards.

29 CFR 1926.1060(a):The employer shall provide a training program for each employee using ladders and stairways, as necessary. The program shall enable each employee to recognize hazards related to ladders and stairways, and shall train each employee in the procedures to be followed to minimize these hazards. On or about November 9, 2023, and at times prior to, employees were not trained to recognize and avoid hazards associated with improper ladder and stairwell use. As a result, the employees were exposed to fall hazards in the following instances. a. Employees used an A frame ladder folded and leaned against a support to access the scaffolding and did not recognize or avoid the hazards with multiple employees exposed. b. Employee used the stairwell of the residential structure that did not have stair rails to minimize fall down the stairs.
