29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels were not protected by guardrail systems, safety net system, personal fall arrest system, or other approved alternative fall protection system: (a) TCL Contractors, LLC, 17065 Opal Hill Drive, Parker, CO, 80134: On or before November 28, 2023, the employer did not ensure that employees were protected from injury, in that six employees removing and installing shingles on a single-story residential home, with a roof pitch of approximately 6-in-12, were not utilizing a fall protection system. Three employees wore fall harnesses; however, they were not connected to the fall protection system that was installed on the roof. Three other employees were not wearing any PFAS. This condition exposed the employees to a fall of approximately 11 to 16 feet to the ground.

29 CFR 1926.503(a)(1):The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: (a) TCL Contractors, LLC, 17065 Opal Hill Drive, Parker, CO, 80134: On or before November 28, 2023, the employer did not ensure that each employee engaged in roofing operations was trained to recognize the hazards of working at elevation and trained in the use of fall protection. Employees removing and installing shingles on a single-story residential home, with a roof slope of 6-in-12, did not utilize a fall protection system. This condition exposed employees to fall hazards ranging from 11 to 16 feet.
