29 CFR  1926.501(b)(13):  Each employees engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):  265 State St., Belchertown, MA 01007: On or about November 29, 2023, two employees were exposed to fall hazards of approximately 9 feet 6 inches above a lower level, while performing shingle replacement work at a residential construction site and were not protected from falling by guard rail systems, safety net systems or a personal fall arrest system.

29 CFR  1926.503(a)(1):  The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  265 State St., Belchertown, MA 01007: On or about November 29, 2023, the employer had not trained employees to recognize fall hazards and on the procedures to be followed to minimize these hazards, prior to exposure to fall heights of approximately 9 feet 6 inches during a residential construction project.

29 CFR  1926.1053(b)(4):  Ladder(s) were used for purposes other than the purpose for which they were designed:  265 State St., Belchertown, MA 01007: On or about November 29, 2023, the employer had not ensured that ladders being used to access a residential roof were used only for the purposes they were designed.  A material hoist (shingle lift) ladder, not designed for climbing, was used by employees to access the roof.
