OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were not protected from the hazard of infection by Legionella bacteria and were at risk of developing Legionnaires' disease: On or about December 12, 2023, and at times prior thereto, and continuing thereafter, employees were exposed to Legionella pneumophila bacteria while cleaning the "Y" strainers of the cooling tower's water system in the following instances: a) Two "Y" strainers in the vacuum equipment room b) Two "Y" strainers in the compressor room.
