29 CFR  1910.134(e)(1):The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  In the Main Shop, employees engaged in auto body repair activities requiring the use of respirators were exposed to health hazards in that the employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace. Employees were required to use M 6000 Half face respirators.

29 CFR  1910.134(g)(1)(i)(A):Respirators with tight-fitting facepieces were worn by employees who had facial hair that came between the sealing surface of the facepiece and the face or that interfered with valve function:  In the Main Shop, employees engaged in auto body repair activities were exposed to respiratory hazards. The employer did not ensure that employees required to wear 3M 6000 Half face respirators were clean shaven thus preventing the respirator from adequately sealing.

29 CFR  1910.1200(f)(6)(ii): Except as provided in 29 CFR 1910.1200(f)(7) and 29 CFR 1910.1200(f)(8), the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals and which, in conjunction with the other information immediately available to employees under the hazard communication program, would provide employees with the specific information regarding the physical and health hazards of the hazardous chemical:  In the Main Shop, employee(s) engaged in auto body repair activities were exposed to health hazards in that the employer did not label secondary chemical containers such as but not limited to AkzoNobel High Performance Reducer Medium (paint thinner), which may cause drowsiness or dizziness, and may cause central nervous system depression. The listed chemicals are used for daily production operations by auto body repair employee(s).

29 CFR  1910.132(d)(2):The employer did not verify, through a written certification, that the required workplace hazard assessment had been performed:  In the Main Facility, employees engaged in auto body repair activities were not provided with a hazard assessment or written certification to identify the proper personal protective equipment required to safely perform the job duties where hazardous chemicals are used. Hazardous chemical include, but not limited to AkzoNobel High Performance Reducer Medium, AkzoNobel Elast-O-Actif, and AkzoNobel Colorbuild Plus Underhood Additive.
