29 CFR 1926.651(j)(1):Adequate protection shall be provided to protect employees from loose rock or soil that could pose a hazard by falling or rolling from an excavation face. Such protection shall consist of scaling to remove loose material; installation of protective barricades at intervals as necessary on the face to stop and contain falling material; or other means that provide equivalent protection. On or about November 21, 2023, at 6207 US 51 Bus. in Weston, Wisconsin, employees were exposed to stuck-by hazards working at the excavated side of a 12-foot high hill without any protection for falling loose soil while they were constructing a retaining wall.

29 CFR 1926.706(b): All masonry walls over eight feet in height shall be adequately braced to prevent overturning and to prevent collapse unless the wall is adequately supported so that it will not overturn or collapse. The bracing shall remain in place until permanent supporting elements of the structure are in place. On or about November 21, 2023, at 6207 US 51 Bus. in Weston, Wisconsin, employees were exposed to stuck-by and crushing hazards during construction of a 12 feet high Redi Rock Block retaining wall without adequately sized foundation and wall blocks. There was no engineer plan provided prior to the start of construction which lead to the wall collapsing.
