29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system: On or December 6, 2023, the employer did not ensure the employees laying TPO on a commercial building with a low-sloped roof, approximately twenty-five (25) feet in height, were protected from falling. An employee worked outside of the established warning line system and was not protected by guardrail, safety net, personal fall arrest system, or safety monitor.

29 CFR 1926.502(f)(1)(i): When no mechanical equipment was being used the warning line was not erected at least 6 feet (1.8m) from the roof edge: On November 30, 2023, the employer did not ensure that the warning line system used, while employees were placing TPO onto an approximately twenty-five (25) foot tall low-sloped roof, was erected at least 6 feet from the roof edge. The warning line system was erected approximately four (4) feet or less from the roof edge.

29 CFR 1926.502(f)(2)(ii): The rope, wire, or chain was not rigged or supported in such a way that its lowest point (including sag) was not less than 34 inches (0.9 m) from the walking/working surface and its highest point no more than 39 inches (1.0 m) from the walking/working surface. On or about December 6, 2023, the height of the employer established warning line system exceeded 39 inches above the working surface in most locations, on a low-sloped roof approximately 25 feet in height.
