29 CFR  1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:   On or about November 30, 2023, the employer failed to establish a lock out tag out program consisting of an energy control procedures, employee training and periodic inspections before performing any servicing or maintenance on equipment that could cause injury to employees.  a) Employees are performing servicing and maintenance on the Old Line Mixer 1 once a month, including removing the packing out of the mixers and cleaning the packing that is used around the mixing blades.  b) Employees are performing servicing and maintenance on the Old Line Mixer 2  once a month, including removing the packing out of the mixers and cleaning the packing that is used around the mixing blades.  c) Employees are performing servicing and maintenance on the Old Line conveyers, including performing routine cleaning.   d) Employees are performing servicing and maintenance on the New line  FPB Optima blend  once a month, including removing the packing out of the mixers and cleaning the packing that is used around the mixing blades.

29 CFR  1910.212(a)(1):  One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:  On or about November 30, 2023, the employer failed to provide machine guarding on rotating parts and ingoing nip points of machines.  a. The old line the conveyers rotating parts and ingoing nip points were not guarded to prevent employees from coming in contact with them.  b.  The new line FPB Optima blend employees were exposed to nip points as the bags were being sealed.

29 CFR  1910.212(a)(3)(ii):  Point of operation guards were not designed and constructed as to prevent the operator from having any part of their body in the danger zone during the operating cycle:  On or about November 30, 2023, the employer failed to provide proper machine guarding to prevent employees from having any part of their body in the danger zone during the operation cycle.  a. The Old Line Mixer 1 does not have proper guarding to prevent operators from having any part of their body coming into contact with the mixing blades when operating the mixer.  b.  The Old Line Mixer 2 does not have proper guarding to prevent operators from having any part of their body coming into contact with the mixing blades when operating the mixer.
